Hello,

My last tenant was a trouble for me as he just stopped paying the rent and refused to vacate the property, ultimately I had to complain his professional bosses and tenant vacated the property only then.

I had a normal rental agreement in which there was not any strong clause for circumstances like this.

Can you please suggest me some clauses or laws which can give me power to ask tenant to vacate the house for, say, one month notice period and if he fails it, so to impose some penalty like Rs 1000/- per day or something?

In nutshell I want a strong rental agreement

A.Dear Sir,
Penalties etc cannot be inserted in the rent agreement.
RENTAL AGREEMENT

THIS RENTAL AGREEMENT is made and executed on this 1st day of May of 2011 at Bangalore, BETWEEN: SMT.ARUNA.M, represented by her husband SRI.ANANDA REDDY, R/@6/10, Bandappa Colony, New Byappanahalli Extension, Indiranagar, Bangalore-560038, herein after called the ’LESSOR’ of the One Part. RATNESH KUMAR GUPTA, S/o Kanhya Lal Gupta, R/@ No.10/51, Adarsh Nagar, Murai Ka Bagh, Raebareli, Uttarpradesh- 229207 hereinafter called referred to as the ‘LESSEE’ of the Other Part.
The term “LESSOR” AND “LESSEE” wherever they occur shall include their legal representatives and assigns.
Whereas , the LESSOR is the absolute owner of the schedule property bearing old No.10, new No.30 khata no.31 situated at Chinnapana Halli Village, Ananda Nagar, Bangalore East Taluk, Mahadevapura C.M.C now BBMP Marathahalli, Bangalore 37, which is morefully described in the schedule hereunder and hereinafter referred to as schedule property.
Whereas, as the LESSEE offered the LESSOR to take up the schedule property in lease for a monthly rent of Rs.4000/- which offer has been accepted by the LESSOR subject to the terms and conditions set out hereunder.

THIS IDENTURE WITNESSETH AS FOLLOWS:
1. In pursuance of the above said recital the lessor has agreed to let-out on lease the schedule property to the LESSEE for a monthly rent of Rs.4000 inclusive of water charges. The rent enhancement shall be increased 5% every 11 months once.
2. This lease period will be for 11 months from 1/5/2011 and the LESSEE shall have the option to renew for a period of 11 months for consent of both the parties with a separate terms and conditions.
3. The LESSEE hereby covenants that they will pay the rent of Rs.4000 inclusive of water charges on or before 10th of succeeding calendar month.
4. Keep the schedule premises clean and tidy.
5. Pay the electricity charges to the respective authorities every month.
6. Permit the LESSOR or person authorized by him to enter and to inspect and attend the necessary repairs relating to the schedule property.
7. Not to alter or damage the existing structure during the lease period.
8. The schedule premises shall be used only for a residential purpose and not for any other purpose.
9. They shall not sub-let or assign the schedule premises to anybody and not change or alter the nature of the interior of the schedule premises.
10. It is mutually agreed between the parties, the LESSEE desirous of vacating the premises before the expiry of lease period, he shall be at liberty to do so on giving two months notice in writing.
11. The LESSEE shall pay one month rent for painting charges to the schedule premises at the time of vacating the schedule premises.
SCHEDULE
All that piece and parcel of house property, bearing old No.10, new No.30 khatha No.21 situated at Chinnapana Halli Village, Ananda Nagar, Bangalore East Taluk, Mahadevapura CMC (now BBMP) Marathahalli, Bangalore 37 a portion of 2nd floor consisting of 2 bed rooms, hall, kitchen, separate bath room, and lavatory.
IN WITNESS WHEREOF THE LESSOR AND LESSEE have signed the agreement on the day, month and year first above written in the presence the following witnesses.
