Hi,

I purchased their all season offer package on 5th August 2018 under the name of my wife, Rekha Kumari and paid Rs. 97000/- instantly using my credit card (12 EMIs). This package was to be valid for 10 years and allowed stay of 70 nights in India and abroad. All the properties to stay be of 4 or 5 star as this package was for luxurious stay.

I tried for booking 2 times in last 1.5 years. In 2018, they first denied booking by saying that I have requested for booking too early. Then I tried for the second time and they said the property was not available on the requested dates. I tried second booking in Oct 2019, this time again they asked the same thing that I have requested too early and need to wait for the opening window. When I checked on other online portals then it was clearly showing that all the rooms of said property were full on that date. I asked them to give me the RCI card as promised by them at the time of buying the package then they denied of such commitment. When I asked about the booking charges then they asked me to pay exchange rate + AMC for booking.

Dispute :-

At the time of signing the agreement, their manager Mr. Imran promised below things to us -
1. RCI card will be given to me after 90 days of registration ((Also mentioned in the starter kit mail sent by them) so that I could book hotels as per my need and there would be no dependency on Starinn Suites and Retreat for booking.
2. All starinn properties are of 4 star and 5 star - This is wrong
3. I'll need to pay exchange rate for RCI hotels and Annual Maintenance Charge for Starinn properties. But in agreement, it was written that Annual Maintenance Charge would be applicable for all types of properties. When I objected on that Mr. Imran assured me that he would arrange a mail and later on, he denied. Same ways, I objected on many points which were not looking customer friendly but he assured that mail would replace all those clauses and there would be no problem in service so those clauses would never be invoked.
4. This is all season offer and there will be no blackouts

Proofs:-
1. I have a mail chain where their representative has confirmed that "AMC is for starinn property and Exchange rate for RCI"
2. It's clearly mentioned in their starter kit that RCI card will be sent to the customer but they denied to send it. Even MR. Imran confirmed me on Whatapp that they were to send RCI card when i asked him, after 90 days of registration.

You may get issue a legal notice and then approach Consumer Court for reliefs.

A.Dear Client,

Collect all the correspondences, text messages/whatsapp chats, brochures etc., any material that is relevant to the issue. You may consult a lawyer and issue a notice for 'deficiency of service' under the Consumer Protection Act and ask for refund and compensation.

Since there are in numerous complaints already, you may also directly file a complaint before the District Consumer Forum claiming compensation and refund of the amount paid.
