Reclaim on property

My Fater buy a piece of land on her wife name.
After his death my mother written this piece of land to her younger son telling that she has only one son in court.
Now i am the elder son and i want that this property withdrawl to my younger brother should proove Unfair and partitionise this land in two equal halfs.
This happened somewhere in 2009 and 2010 without my imformation.
Now how can i proceed to achieve it???
Please tell me best solution.

A.Make a legal Heir Certificate of your family starting from your great grandfather, then upon that basis you can claim such.
