I am Vishal Rai. I have question on behalf of my sister. She got married on 16 Feb 2020. But after two months she got to know that her husband's got affaire with his aunty and he also doesn't talk and not good behave with my sister so my sister decided she doesn't want continue with him and we also want all our things which we have given during sister marriage like money appliances and furniture jewelry.

A.Hi,

This is a solid ground for divorce but a divorce petition only can file after a year of the marriage. please consult with a lawyer for suitable on annulment or have to wait for one year to complete.

A.You can immediately collect standared evidence and file divorce application if does agree for mutual divorce

How to move ahead with your sisters case shall depend on what are the present circumstances, as in whether her husband is aware of intentions of your sister and whether any proposal has been given to him by your sister? If there has not been any proposal as yet, it is advised that she takes all her belongings including streedhan and steps out of her matrimonial house and then filed appropriate litigation seeking permanent alimony/maintenance.

A.As you have write that date of marriage is 16 Fab 2020. So you can't apply for divorce before one year you can apply for divorce with valid ground which you not have now
first collect valid grounds then make separate with mutual consent.
