I taken lease from x person but he is sold the property in the year 2017 to the person Y, person Y has taken home loan on the property which we are currently staying, y not paid any EMI till now on the loan amount, so now bank person saying that they are going to sell the property, we are not aware of that Y is current owner of the property, so please suggest me to get back my lease amount.

A.You can lodge cheating case against all the persons concerned including bank. The field staff of bank has an obligation to visit the spot and make mahazar. Please give me Rank 5 if you feel my answer helped you.

A.Get injunctions on the bank to alienate the property. Further, file an objector objection in the SARFESI proceedings. Also, issue a legal notice before you take up the above to all the party.

A.1) You have not mentioned in which year you have taken the lease of the house from the person x ?
2) Is your agreement registered agreement and what was the start date and end date of the agreement?
3) What is the deposit & RENT you are paying to Mr X since 2017 ?
4) What kind of property is this ?
5) In which year was staying as when the PERSON Y has taken the home loan by default the bank persons must have come INSIDE YOUR HOUSE/ PROPERTY in the society & by DEFAULT YOU would have come to know about the same.?
6) Now tell the bank person only to give your DEPOSIT AMOUNT if you are having the Lease / Rent Registered agreement copy with you
7) Ask the person why how has he i.e. MR.Y allowed you to stay in the source and property without any knowledge of Mr. X and here is where we will get the solution from the person.
8) why as this person who is Mr. Y not knowing about the earlier deal from which you have completed from MR.X..
