I had tenanted a residential house from 5 years, But recently since 4 months he is not paying rent and absonding since he has taken huge amount of hand Loans from local people . His advance is small amount and he is not traceable. All loan givers are daily coming and damaging my house windows, glasses and pelting stones at the house. I have complained to Police station also. I need my house position immediately and house keys since he has not vacated the house. Please advise

A.You need to send a legal notice for eviction of the property to his known address to respond and clear the outstanding. After the notice please move to the court for eviction order.

A.Take permission of Police, keep some witnesses and brake open the lock and arrange a mahazar of materials inside and keep them in one room. Vdeograph entire work. though a bit risky, this worked for my clients.

A.Since he has defaulted in rent payment you can take immediate possession of such property. But, by notifying the rent controller.

Thanks for your advise, But the Rental Agreement original which was made 5 years back is with Tenant only and copy is not with me also, and every month he paid 6000/= by cash only with no receipt.Shall i proceed to meet Rent controller and appraise the same.

Yes. you must. Since he has defaulted the rent and is on the run you can appraise the same.

Also you need to aprraise the rent controller about his belongings left in your tenanted room.
