I had been working in an automobile dealership as senior manager since past 1.5 years.Recently last month i had resigned from my job due to personal issues.My resignation was accepted and i had completed all the exit formalities.But till date after several follow ups they have not credited my salary into my account.Kindly guide me can i approach labour court or do i have to file a civil suit against them.

A.Dear Sir,
Since you were senior manager, labor laws not applicable. You have to get issue a legal notice and then go to Civil Court by filing
suit for recovery of salary. You will succeed.

A.Whether being a senior manager you can be treated as a 'workman' is doubtful, but sometimes depends upon your concerned state amendment to I D Act. 1948. It also depends upon the nature of work given to you whatever the name given to your designation. If based on what i said above you are not a 'workman ' in your state, then you should file a case not in Labour Court, but in Civil court.

A.Issue a legal Notice to that effect first before going to labour court.

A.first you should visit the head of the office/agency and know that what is issue.

If they agree to clear your outstanding dues then its good otherwise engage lawyer and send legal notice thereafter approach to labor court.
