Dear Sir, Madam,

Our Property is sold illegally by HDB Financial Services Ltd, while the Case is still pending with DRT1 Chennai. we have EC Copy as a proof for the sale executed. Note: All our Belongings are still in the Property under dispute

Actions taken from our Side so far

1. Email Sent to CEO of HDB Financial Services, Copying Respective Bank Officer, RBI, Tamilnadu Registration Department
2. Online Complain to PM Office (also Personal Email to Prime Minister)
3. RBI (Separate Complaint to RBI Ombudsman)
4. Email to DRT1 Chennai (Debt Recovery Tribunal)
5. Online Complaint to CM Cell, Tamil Nadu
6. Email Complaint to Respective SRO, DRO, DIG of Registration Department

Due to Covid-19 Situation, DRT1 Chennai is closed or very limited cases are brought in

Our Advocate suggesting to take up this issue in Argument or we can file Contempt, when court opens

Kindly advice the next steps that we should to follow in regaining our property legally

A.Hi
In general, under SARFAESI Act, unless there is a stay granted by DRT, banks are empowered to conduct an e-auction. However the same shall be subject to final order of DRT-1.
DRT-1 Chennai is hearing cases through video conferences and your advocate can move DRT-1 for any interim relief.
If your I.A for interim relief is dismissed by DRT-1 , you can always approach the High court under Article 226.
Sad, that banks are using present covid to their advantage.
