A.If you're not being paid and there is threat for retrenchment of you along with other employees, you can approach Industrial Dispute Resolution Tribunal under Section 25F of Industrial Disputes Act.

A.You can merely pursue for salary. You can issue legal notice and can file recovery suit. Insolvency laws relating to financial creditor stand suspended so you cannot proceed under Insolvency laws. The limit to proceed under insolvency law is Rs one crore.

A.Have sent multiple Legal Notices over the lockdown period to employers who are not paying salaries/benefits to their employees.

Everyone is facing cash crunch but it is important that you take action and assert your rights. You should guarantee your salary immediately and get written confirmation.

A.In order to reply to your query, you need to give details of your employment, terms and conditions of your employment and probable reasons for not paying salary to you by company.
Further, details of days / months for which salary is not paid.
If the company defaulted in paying salary to you, you need to issue notice for release of your salary, followed by filing your case before appropriate Forum seeking relief against the company.
