Is dtinking in public illegal ? I read somewhere that it is not ! Only if u create nuisance after drinking then it is illegal.
Plz tell me whats the law on this ?

A.Dear Sir /Madam,
There are specific laws as per the state govt regarding drinking in public.
As in Delhi there is fine of Rs 5000/- or imprisonment or both

A.Under police rules and punjab laws, drinking in public place is illegal. Donot rely on any unauthentic literature.

Maharashtra has a permit system under the Bombay Prohibition Act (1949). According to this Act, purchasing and drinking alcohol without a permit is an offence. ..

A.What do you mean by public place:

Public Place Means:
..........""Public" in this context refers to outdoor spaces such as roads, walkways or parks, or in a moving vehicle. Drinking in bars, restaurants, stadiums, and other such establishments, for example, is not generally considered to be "in public" even though those establishments are open to the general public ........."

BUT

Under relevant provisions of "Excise Act" (Applicable to concerned State) it says that, if a person is found to:
(a) consume liquor in a public place;
(b) consume liquor in public place and creates nuisance; and/or
(c) permits drunkenness or allows assembly of unsocial elements on the premises of liquor establishment; shall be punishable under law.

In your case, provisions of THE EXCISE LAW of your State are applicable to you.

A.1) Drinking in any public place is illegal in India and it attracts a fine of Rs. 5,000/- to Rs.10,000/- and OR term period of 3 months of jail or both....
2) Even drinking of alcohol in a parked car or your own car in a public place is also prohibited…. even if you are caught in a parked Car & you are not drink and driving then also you are liable for all the fine and also the vehicle can be seized by the police and you will have to get release from the COURT itself..
3) If incase you get caught be ready for settlement
