Hello sir
In order to purchase a land property I gave 10laks to the land owner (the land was in case ) I waited nearly more than a. Year so I asked my money but he is not returning he is cheating me

A.Dear Client,
You must have documents for making payment to builder, if yes or not, in both case issue him a letter from your side stating all, if not giving reply, then make issue a legal notice, if not paying, file consumer case against him

A.I have gone through your query in detail.
When you was knowing that the land property was already having a case …why did you give him 10 lakh rupees …For this 10 lakh rupees you will have to buy new shoes to run behind him day and night.. have you made any written anything from him.. any document for your safety if not then time to send him a strict legal notice and if it was given by cash without any documentation you may have to go through the other way around if you are ready we have the way..

A.You can file a complaint with police for cheating and also you can file a civil suit for recovery of money as well.

A.In order to get back your money you need to have proof of said transaction i.e., giving of money and offer to purchase the land.

If you have both the above proofs, then you need to get the notice issued to him for execution of sale deed failing which you need to cancel the agreement and demand him to repay the money advanced by yo to him.

If he fails to honor your notice, you need to approach civil court for recovery of money

Based on the material / proofs available with you, you MAY also initiate criminal proceedings against him for attributing appropriate criminal charges against him.

NOTE:
The above option can be availed subject to applicability of provision of IPC & Cr.P.C.
