Respected Sir/Madam, I am a freelancer based in Guwahati, Assam. I offer services in translation, transcription, proofreading and content writing. I have been freelancing for a Delhi based company since January 2020 on project-to-project basis. Their work order mentions payment within 45 days of receiving invoice. I have been raising monthly invoices since February til July, but payments are not made properly citing different excuses. They have not yet paid even 50% of the dues. Kindly advise how to proceed.

A.In order to guide you properly, the terms and conditions of your offer letter / appointment letter needs to be perused. Going by contents of your post, if your claim is valid, then you can write a formal letter to them requesting for release of your payment. Failing which, you can issue notice seeking settlement of your dues in line with the terms and conditions of your agreement. Followed by filing suit for recovery of money and also you can initiate criminal proceedings against them.
NOTE:
Better avoid litigation, it is a long drawn proposition, it may have adverse affect on your career / profession.
Try to settle the issue amicably, if it goes beyond permissible limits, you may have to take legal route.

A.You will have to send a legal notice. Because of corona there is a cash crunch, but a legal notice would aid you in letting the Employer know how serious you are about pursuing this amount. I have had instances where payments have been made in part and parcel due to legal notice.

Thereafter, the remedies are myriad in terms of civil suit etc.

A.You can file money recovery suit plus Rs.2 lacs towards mental torture. They will come down.
