Sir I have been working as a seafarer since 1999 2 months back I had an accident at Hongkong port while on duty onboard ship..The ship was about to leave the Harbour so I have no chance to take treatment immediately after 20 days of sailing to Auckland Newzealand.i was send to Dr for check up there Dr take exray found l4l5 disc problem and declared unfit for duty company decided to send me home town for further treatment but due to corona no flights so I remained onboard ship but no work after the incident (one month) company managed to send me home on arrival india everywhere lockdown and I was not able to go for treatment..and I tried to take e pass and I went to Hospital.the treatment was on going couple of weeks before I had a civier chest pain I was admitted in the Govt Hospital as other hospitals are refused to admit me and I was put 3 days in icu and 4 days in other ward and discharged.Dr advised me that I have some blocks in blood vessels better go to private hospital and get cure.finally I went to a big hospital in tamilnadu after corona test shows negative then they admit me and done Anjio put 3 stents and advised atleast for a year not to under go for any surgery my Question is when I joined ship I was full body fit declared by my company doctor and I had a back injury onboard ship and unfit then I had to come out from ship now what will happen for me do I eligible to claim my permanent disable compensation from my company please advise me sir

A.Yes you are eligible for permanent disability compensation, as the incidence was happen when you are on duty, and your company itself declared you unfit.

A.Yes, you are eligible to claim compensation, since your injury has apparently arisen out of the course of employment.

A.Dear Client.
As per your inputs it is clear that you have injury during the course of your job, so you can claim compensation from your employer, further if your health is not supporting to work for more hours then you can ask them to shift your nature of work due to your health grounds., if your employer not satisfied your demands then you file a petition in the court

A.Dear Valuable Seaman Client,

1. First Get a Advise from the Ortho Specialist about the curing of this surgery to normal.
2. If Doctor Advise is positive it is normal then no issue.
3. But If you feel you are not able to work continuously for 12 to 14 hours it is an serious issue in merchant ships.
4. If Doctor report saying that need some rest or not to work on continuous 8 to 10 hours then my best advise is get compensation from the Merchant Ships.

Dear Client My advise for you if you feel I can work continous work with ship for 10 hours by sitting and standing it is not an issue at all but if you feel high pain, dissiness, sudden head ache, stomach issue it is best advisable to get compensation from the Merchant Vessal company.

Get a Permanent Lump Sum Payment from the Merchant Vessals companies. if you find difficulties.
