Hello..
There is an ancestral property of my mother's side...she has no brother...Her father died 13 years back and mother 2 months back...Now my mother's real sister wants to sell the house and keep all to herself..She is saying that property has been transferred to their mother's name and she had given her power before death to do what she wants..She is claiming that she had the papers..But we checked in the corporation and there it is coming that property is in the name of my mother's great grand father and grand father...We don't understand how she is saying that house has been transferred to their mother's name??? And how can my mother get her share???

A.you contact to an advocate who is practicing in civil cases and file a suit . you will get your share as you are legal heir and have right but do it at faster speed before she could transfer or sale this property other wise you will have to do long and expensive exercise

A.Even assuming that the property stands in your grandmother's name, your mother's sister has claimed ownership of the property based on an alleged POA said to have been executed by her mother (your grandmother). Since your client's mother passed away, the POA is invalid and hence your mother's sister cannot claim any right over the property.

Your mother can very well seek for partition of the property claiming her share.

A.What you can do is look for a good property lawyer or civil lawyer and then file a partition suit in the local civil court. When you do so your aunt will be forced to come to the court with any paper that she claims to have in her possession.
