Hi. Can an organization bring in additional advise of an external lawyer formally where an investigation of sexual harassment is underway by ICC. I learnt from someone that this can not be done & the advise can only be informal.

A.The ICC itself comprise of Presiding officer, an external member and an Employee member. Despite if the organization is engaging an advocate for advising its ICC it can do so, there is no harm. The main concern should be that under no way the principle of natural justice should be infringe.

A.Hi,
The ICC of an organisation should have an external member. You can take advice of such external member. Other than that, legally you cannot take advice of any third party in the matter. In fact there is a requirement to maintain confidentiality of the proceeding.

A.Yes, if the ICC is inefficient in performance of the investigation then a organization bring in additional advise of an external lawyer.
