Can we cancel the registration or sale deed agreement if the stipulated amount is not paid by the land buyer after registration?

A.Hi,
It is advisable that you contact the buyer and demand the amount not paid, if the buyer refuses to pay then you can institute a suit against him for recovery of money.

As per your inputs you have registered the property in spite of receiving full amount, if the registration is conditional the same may be cancelled. you need to issue legal notice describing the details then you shall proceed to court

A.Dear Sir,
You can get issue and cancel however it deemed cancelled as maximum period of 4 years already crossed and you need not repay the advancement amount paid by the buyer.

A.If no time is mentioned for execution of sale deed, it should be registered in reasonable time. Usually time in such transactions is 90 days. As the agreement is signed prior to 4 years, time for execution of sale deed has elapsed. Issue a written notice to the other party asking him to close the deal within one month, warn him if it is not so closed deal will be cancelled retaining the expenses incurred by in executing the agreement, notice charges and an amount of 20 % of the advance as penalty. In fact you can claim more than that. Give me ratings if the advice is useful to you.
