Mine is a state autonomous research institute. As per rule 21 of service rules of institute all employees are entitled to get pension as per state government employees. In accordance to rule 21 the government order dated 09.09.2010 was issued by state government to provide pension facility to retired employees of institute after which we are getting pension. The state government provided fund for salary and other allowance through annual budget sanctioned for institute. But now the government has denied to provide fund for payment of pension. Government asked institute to pay pension through its own resources which are insufficient for this. The government is now trying to implement self financed pension scheme in institute. Government after issuing order dated 9.9.2010 by which it sanctioned pension facility to retirees again passed an order on dated 25/04/2011 by which government has provided one time financial assistance of Rs 5 crore for payment of pension and asked institute to pay pension through annual interest accrued on 5 crore + 50% of institutes own income. Now this scheme is overburden due to high number of retired employees. As per various G.O the institute is paying pension in accordance with fund available in scheme due to which we all are getting 35% of our pension every month. Now what we should do to get pension as per ppo. How government can change service condition of employees after their retirement. the service rules were approved by government in year 1976 and 2006 and 2009. All earlier government order entitled us to get pension as per state government employees.

A.You can file Writ Petition in High Court and then Court can resolve the issue if your case is found reasonable otherwise.
