How can i take divorce in the case where we married in special marriage act as we were in love and my family not agree. Then we married as per rituals when both family's agreed. When we were about to have 1st child then I got to know the disease which my husband had is a heirardity disease and be passed to my child. Before this I was not aware about the disease my husband had and it was existing before marriage. Since that day we are not together and its 3yrs. He is not willing to give divorce. So how can I take divorce n complete custody of my son asap without much hassle.

A.some diseases and not all diseases are valid ground for divorce.

which heirardity disease
your son also have it then ?
where is son now if you are not together anymore.

Mother gets custody for child upto 7 years.

A.There is no ground of divorce on medical ground..in the law there are 4 5 diseases.on which .you can demand divorce on that medical ground

A.Hi,
Firstly is there any medical certificate to prove your ground? You have to file for a divorce case before the competent court and you can claim your custody of the child.

You can file for a divorce on the ground of concealing an important information. Since you have been living separately for 3 years you can file for divorce under desertion by spouse.
