Lended 6 lakh in cash and 1 lac online transfer to a friend.delaying repayment.He is ready to give PDC and sign the promissory note.but confused that is lending 6 lakhs by cash legal in india.how shall i proceed to get legally safe.also one more thing that my wife is a director in his pvt ltd e-commerce firm.also want to exit from that

A.Hello,

You have to make an agreement-(Friendly Loan Agreement) and mention that" How you lended 6 lakh in cash to your friend" and 1 Lahk through online transfer. You have to mention the dates on which you are given the Cash and Online transfer. if your friend is ready to give you PDS and sign the promissory note then you have to mention that PDS in the said agreement. Further, you should declare this friendly loan amount in your ITR also.

After that present the said PDS in your bank.

As per company act 2013 the Director intending to resign shall send a notice in writing to the Company with reason. The resignation of a director shall take effect from:
The date on which the Notice is received by the company or the Date, If Any, Specified by The Director in the notice, whichever is later.
Further, the law has caste duty upon the Director Resigning, to File Form DIR- 11 (Company shall file form DIR 12) and
-Mention therein the Reason for Resigning.
-Enclose a copy of the Notice sent to the Company.
-Enclose Proof Of Dispatch.
-File the said form within 30 days of resignation along with the prescribed filing fees.

A.Hi,
You can issue certain reminders.However, if he still doesn't pays back the loan amount, you can issue a legal notice to him.

A.Hi,
Initially, you can give your friend certain reminders and offer him installments as a way to pay installments. However, if he still doesn't pays back the loan amount, you can issue a legal notice to him.
