Sir, my uncle get the property from his parents year 1994, though we don't have the information. But now he sell the property. I have found a mistake in the dalil record.there are two seperate dalil records one is of my grandfather dalil & of grandmother. Though the grand mother has given the property which was on her name but the grandfather given also the same property which was grandmother,s property. Not his own named property.though he has the property just beside the grand mother's property. Can we filed a case against him? & What is the possibility to get back the said grandfather property.they are3 brother's & two married sister's.he cheated all .

A.As per your question if there is mistake int he dalil (sale deed) then it is to be understood that the property has not been transferred legally and either the sale deed has to be corrected or you can claim the unsold property. Secondly as you have mentioned that your uncle sold your grandfathers property I think he cannot do that as your father and even you will have rights in that. You can speak to me and seek all advice that you want.

A.Yes you can file a suit for partition then he will come to settlement.
