A.Dear client
The plaintiff i.e. person who filed the case
is unable to perform the order of the court then the court dismiss the petition of the plaintiff it is called dismissal for default. I think In your case also this was happened. The court gave a chance to the plaintiff to file fresh suit.

The facts of the case are not clear. nonetheless, An order of default is a court order saying that one party (usually the plaintiff) has won the case, and the defendant has lost, because the defendant did not participate in the case. The order of default does not settle the issue of how much money is owed. It simply declares that the defendant is legally responsible (liable) to the plaintiff.
However a fresh suit is instituted under section 26 along with Order 4.
