Can I adopt my own sister son.???
My sister got divorced and she has own custody son
My self i am married and i have one son

A.Hi,
An adoption made without the consent of wife is void. If the consent of the wife living with the husband is taken but consent of wife living separately is not taken, the adoption is equally void.
More information is required regarding the fact whether the husband of your sister is ready to give his son for adoption, whether your wife is ready for the same.

A.Hi,
Section 6 of the Hindu Adoption and Maintenance Act i.e. Requisites of a valid adoption states that no adoption shall be valid unless:-
· The person adopting has the capacity and also the right to take in adoption.
· The person giving in adoption has the capacity to do so.
· The person adopted is capable of being taken in adoption.
· The adoption is made with the other conditions of the act.

A.adoption within family keep happening all the time .
but if there is divorce then husband of sister can object to it.
it depends on their divorce settlement.
