my father was having a flat and a land. But now my father has passed away without making a will, so my mother wants to transfer that property to my name and my younger brothers name.
A.As per your fathers legal heir certificate, the property will be shared between your mother and his children, now She can make a release deed for her share of property then automatically children will be the owners

A.your mother can transfer her share to anyone.
but it is advisable for her to make 'WILL' of her share instead of transferring to you and brother.
because of her share she will be better taken care of.
