Girl got married six years ago at the age of 17 and the time of marriage her husband age is 43 and he is close relative. Right from their marriage they do not have any physical relationship. Can she file for annulment if so what is the procedure

A.Hi,
Under Muslim personal law, women above the age of 15 who have attained puberty are eligible to be marry. However, this is in contravention of the Prohibition of Child Marriage Act(PCMA) 2006. The Courts have also given conflicting opinions in this regard.
The marriage can be annulled on the grounds that the girl was a minor at the time of marriage. You will need to collect all the necessary documents, show proof that you have lived in the state of filing for the past 90 days and make the petition at the local Family Court, stating the reasons for annulment.
