• WE ARE APPLYING MUTUAL DIVORCE
• I HAVE A SON OF 5 YRS
• SON WOULD BE IN CUSTODY OF MOTHER
• MY WORRY IS EVEN AFTER MUTUAL DIVORCE, WIFE PLAN IS TO CLAIM ANCESTRAL PROPERTY THROUGH SON
1. What option I have to protect my ancestral property
2. As of Now my father has Gift deeded the entire property to my mother name
3. No property is in my name
4.property has come from almost 7 Generations, but we have documents only which dates back to 3- 4 generations

A.No she can't claim any right in your property after mutual consent divorce because it is a permanent alimony. And both the parties are agreed to it. All the things are mentioned in the petition

In Mutual Divorce include a condition that she declares on behalf of her son that she do not claim ancestral property and in lieu of the same she got enough cash and some portion is deposited in the name of minor son till his majority. Call me.

A.Clearly mention in thevmutul settlement papers that wife will not claim anything in the future. So far as property is concerned, it will devolve as per Hindu succession Act for Hindus.
