My maternal uncles got land in inheritance and their sisters asked for a share in it. They didn't give it and asked them to wait but during this time one of his sister (my aunt) has deceased. Now that aunts son is pestering us,intimidating us and giving us threats for no reason..he's blaming it on my father and asking him to fight with my uncle as my father is considered as head of the family.My father is 73 year old and doesn't have an elder son and only has 19 year old daughter. He is extremely ill and this everyday fights are mentally affecting him alot..we are afraid of our safety since he's bringing a knife with him. This land issue is not our familys concern yet we are struggling in our lives everyday..what can I do legally to stop him to visit our house as he is visiting us getting drunk day and night and also midnight..uses foul words tries to intimidate us woth knife and try to destroy furniture. Please give some legal advice to stop him for this nuisance.

A.Hi,
You can file a complaint with the police under Sections 503 and 506 of the Indian Penal Code for criminal intimidation, Sections 351 and 352 for assault and Section 509 for words or gestures intended to outrage the modesty of a woman. The aunt's son shall have to take up the issue with your maternal uncle, they can file a suit for partition so the Court can divide the property.
On the basis of your complaint, the Court can grant your father protection orders or issue an injunction prohibiting your aunt's sons activity.

You can file a complaint with the police under Sections 503 and 506 of the Indian Penal Code for criminal intimidation, Sections 351 and 352 for assault and Section 509 for words or gestures intended to outrage the modesty of a woman. The aunt's son shall have to take up the issue with your maternal uncle, they can file a suit for partition so the Court can divide the property.
On the basis of your complaint, the Court can grant your father protection orders or issue an injunction prohibiting your aunt's sons activity.
