Can someone make a dispute land claim on reference of some other dispute land

Sir my father have only one elder brother. After death of my grandfather and grandma they verbally divided their share of land in house, Khet and a Daalan. Though at the time of division there were two land which were having dispute with third party. Now all the dispute have been sorted out. But they are not letting us construct in our share of Daalan and want all partition be first happen, then only they would allow us to construct. My questions are if they can object construction in already settled land citing some other khasara no land dispute. Secondly can partition suit be filled in court on aabadi land as the Daalan comes under Aabadi Land

Yes, you can go ahead with filing a partition suit. It is advised to not construct anything until the suit is settled, as there is a chance your investment would end up benefitting the opposite party.
