my wife has alleged in her written complaint that she is working as a Software employee at Bangalore That on 22/12/2020 the complainant had given complaint alleging that she was married to 1st petitioner on 20/11/2009 at Bangalore at about 11 years back and that it was Love marriage, then they formed matrimonial house at Ejipura by taking on rent, in the year 2013 the parents of the petitioner joined them and lived together and in the year 2015 after vacating the Ejipura house they all moved to Apartment , from then on all days without any reason the petitioners used to open conversation and hit, scold, used to harass physically and mentally, saying that if we had got girl from our community we used to get lot of dowry and jewelry so they also demanded complainant to bring the same from her parents’. Seeing the harassment the complaint parents had paid Rs.5 lakhs by way of dowry and the petitioner No.1 brought property at ACES layout at Singasandra, Bangalore in Joint name of complaint and 1st petitioner and started living together there also the petitioners again stated demanding dowry hence she moved out of house along with her son. which is also wrong as me and parents have left the house before her Alleging she sought action against the petitioners. The respondent police have registered a case in Crime. punishable under section 3&4 of Dowry Prohibition Act and IPC (498-A,34). Sir neither me nor my parents have ever asked any money as well as no money has ever been transferred from her family account to my or my parents account

A.Hi,
You can file for anticipatory bail to the Sessions or High Court. The limitation period within which to file a dowry case is 7 years, so your wife does not have the law on her side with regard to the Dowry Prohibition Act. As the cruelty case is false, you can make an application the High Court under Section 482 of the Criminal Procedure Code to quash the complaint. This application must be accompanied with whatever evidence you have to show that the case is false.

The limitation period within which to file a dowry case is 7 years, so your wife does not have the law on her side with regard to the Dowry Prohibition Act. As the cruelty case is false, you can make an application the High Court under Section 482 of the Criminal Procedure Code to quash the complaint. This application must be accompanied with whatever evidence you have to show that the case is false.
