Depends on who was supposed to file the notice. The default can be from either of the sides.

Notice can be filed by both the parties, hence, delay can be done by both the parties. It depends on the case about who delayed in filing the notice.

A.Condonation of delay is filed by the appellant and the objection is to be raised by the respondent in case the application has not been raised by the respondent the condonation may be accepted by the court on the ground provided in the writ petition
