Breach of Contract (TO THE BEST OF MY KNOWLEDGE) Breach of Contract (TO THE BEST OF MY KNOWLEDGE)

The father of my friend took 7-8 lakhs each from 18-20 people under the confidence of getting them a job in the Group C/D of the Indian Army. He was supposed to give that money to a different person who was actually responsible for getting the job done. My friend's father was just a MIDDLE MAN.

With such a huge amount coming in the picture, the actual broker turned against my friend's father and has not got the job done in the last 4-5 years. The people who gave the money to my friend's father, have started becoming impatient are constantly threatening him, despite knowing that he was just the middle man.

My friend's father is a government employee in a school. He will never be able to pay such a huge sum back to the people, from his own earnings. The actual broker is still in touch with him and keeps making false promises that he will get the job done soon.

My friend's family have not gone to the police because they know that they are at fault, too. However, his father had no bad intentions and he just wanted the best for these people, so he tried to help them.

What are their possible options?

A.Hi,
The best thing to do is to file a complaint with the police for fraud and cheating. You friend's father is also a victim as he was unaware of the broker's real intentions. Civil money recovery proceedings can be instituted against the broker by all those who have been aggrieved by his actions. As the limitation period of three years has expired, they will also have to file an application for the condonation of delay, if they have genuine reasons for the same.
