My mom & dad expired in 2008. My sister (married ) expired on 2001. We are 2 brother & 1sister (expired). We want to sale this property but my sister's son want equal share in this property. I dont want to give him any money as my sister was expired. Then how he can claim for equal share. Property is still on the name of my mother. Any solution on this issue. Because i dont want to give property share to him. I want to mention that before 2001 i have fight with my mother & she did NC against me. My sisters son having that copy of NC. Can he use this NC against me to claim property share?
Give me solution what i can do, i dont want to give share.

A.Dear Sir,

Immediately you may enter into sale deed and sell the properties if they are standing in your name. Otherwise unnecessary litigation may crept in and matter will be prolonged. On the basis of NC you try to get the records changed in your exclusive name.

This property is on the name of my mother so i cant sale directly because 1 brother is also there. I want to know Law is in my favour or my sisters son favour? Pls advice.

As per Hindu Succession Act my sisters son is eligible to claim for equal share in this property or not?

As per partition suit how much % share of the property i have to give my sisters son?
