An unknown man comes to my house and accuses me of having and affair with someone I know ; which is not true. I don't know his name and address. He tells my neighbours and many others about this.Can I sue him with defamation charges?

A.First find out his name and whereabouts then you can file defamation case in court or can file a nuisance case against him in local Police Station

1.The Statement should be made
2.The Statement must refer to the plaintiff
3.The Statement must be defamatory
4.The intention of the wrongdoer
5.The Statement should be false
6.The Statement should not be privileged
7.The Statement must be published
8.The third party believes the defamatory matter to be true
9.The Statement must cause injury

A.Hi,
A criminal defamation can be filed through private complaint with magistrate under section 499 and 500 of Indian penal code. There is no court fees in criminal matters expect ticket fees. The procedure in civil court and criminal case take time.
