My daughter got married 2 months ago. She found that he is a fraud. How can she get justice. Divorce take long time. How can she survive. Does she get divorce settlement.

A.you have to deal with the situation very carefully as you have detected that he is a fraud. I give you one golden advice. File a case against him under section 125 of Cr.P.C. Your matter would be sorted out in six months.

A.Hi,
She can opt for an annulment as the marriage happened less than one year ago. She is entitled to maintenance; the quantum of this maintenance shall be determined over the Course of the hearings, taking into account the standard of living both parties are used to. Until the final amount is determined, she can claim interim maintenance under S.125 CrPC.

She can opt for an annulment, this doesn't carry the same stigmas as divorce but has the same effect of separating the spouses. Yes, she is entitled to a lumpsum settlement or monthly alimony. You can claim interim maintenance under S.125 CrPC before the final alimony is determined.

A.Your daughter is entitled for monthly maintenance from her husband. And if the court grants divorce then it will also decide the amount of permanent alimony. So ask for permanent alimony when divorce petition is filed. However, no petition of divorce can be filed within 1 year of marriage unless there exists some extraordinary circumstances.
