Im a female and have 2 small sons of age 5 and 3. I am currently at my mothers place due to harassment from my husband and his family. He is not giving any money for our expense. I am not working so don’t have any financial support. I want to know how to file for a divorce and ask for expense money

A.Hi,
You can claim interim maintenance under S.125 CrPC before the final settlement amount is determined. You can file for divorce by presenting a petition in family Court, you can do it on the grounds of cruelty under S.498A of the Indian Penal Code.

You can claim interim maintenance under S.125 CrPC. If you cannot afford a lawyer, you can approach the State Legal Aid Cell for free legal representation.

A.U/S.2 of Dissolution of Muslim Marriages Act 1939 you can file Divorce petition.
Lian can file if there voluntarily and aggressive charge of adultery made by husband.
1)Maintenance U/S.125 CrPC
2) Maintenance Under DV Act.
3) U/S. 3 of The Muslim Women (Protection of Rights on Divorce) Act, 1986.
Under section 7 of Family Court Act,1984 wife can file for return of ornaments, money and property..if any
