I run a private limited company. We provide engineering services. Two months ago the company received a large order from our customer. To accomplish this, we needed to buy some equipment. We finalized the bid of a proprietary company and transferred 50% payment (Money transferred from our company's current account to its company's current account). But after transferring the money, the supplier is not answering the call or mail. The company lost the order because of that. Which also ruin our company's reputation and waste the company's money. Now he is neither supplying the equipment nor returning our money. All communication is done over mail. Please help me what legal action I can take.

A.You have been cheated. You should have a strong evidence to prove all the payments made. File a Cyber crime complaint & also have legal assistance. A expensive process but other wise the other company may just walk away Scot free.

A.In this case Suit for money recovery or specific performance will helpful as civil nature of case takes time so simultaneously file police complaint under FRAUD and cheating and various other penal law APPLICABLE as per briefing of case ,

A.Hi,
You can file a civil suit for money recovery or specific performance. In addition, you can file a complaint with the police for cheating and fraud under Sections 415 and 420 IPC.

A.Hi,
You can recover your money through a civil money recovery suit. Alternatively, you can file a suit for specific performance after which he will have to deliver the equipment and pay any penalties.
