I am a Muslim Man from Srinagar and I got married last year and after spending 1 month with her she started behaving insanely and was not interested in any thing be it work of home or other things which lead to the quarrel each day, i was in a relation with her from last 6 years but the moment i married her and bring her home she started behaving weardly and accused that my family harasses her and tortured her which was not true, every day she complained me of doing nothing and tortured me mentally now i want to Divorce her and she is not agreeing and she has gone to court and filled DV against me and my family

Also please be informed that she is suffering from BI POLAR disorder and taking medicine from last couple of years, and couple of days ago she came with her lawyer and took all there belongings which was in my house and we got the reciept of that also signed by her lawyer with stamp and in presence of two witnesses. Please advise what to do and do i have to give penalty for divorcing he

A.No you will not be penalized. You can divorce her as per Muslim law. But have to pay maintenance until she gets married or until her lifetime.

A.You can Islamic method for divorce.
As per Islam you have to pay maintenance until the iddha period is over.
In India husband has to pay maintenance upto her second marriage or death including alimony.
No there is no penalty you can divorce her

A.Hi,
She has a right to claim some amount from you as maintenance during and after the divorce proceedings. You can use her mental disorder as a ground for divorce if she is unwilling to agree to a mutual consent divorce.

A.Hi,
You will have to pay some amount as maintenance after the divorce has been effected, she has a right to claim the same from you. You can apply to the High Court to quash any false claims under S.482 CrPC.
