Daughter have right in mother property

We have property in kundapura. My grandfather(mother father) purchased. My grandfather did weel to mother name. We are 3son &1daughter. My mother died in 1970.my sister married on in the year 2000. Now our RTC has only 3sons name. If now we applying for partition deed. My question is whether court make it 3divide or 4divide(including daughter)
A.Court will divide into 4 parts including daughter. if she signs NOC stating that she doesn't want .
