If the person is outside india and still some other person signs the legal declaration with the developer can that document be considered as valid documents. And what action can be taken against such practice against the notary and advocate. Can it be proved with passport entry and exit record. Note :- there is no power of attorney issued in favour of the person who signed the documents pretending to be the same person with his government id.

A.Hi,
If the person was not a GPA holder, then the documents would not be valid as the signature was a forgery. The same can be proved before the Court.
The offender can be punished for fraud and forgery under Sections 420 and 464 IPC.

A.Hi,
No, they cannot be considered valid as the signature is fraudulent. The forger can be punished under Sections 420 and 464 IPC for fraud and forgery. Yes, such forgery may be proved.

A.If the person who has signed the declaration does not possess any legal right and authority of origional owner then such declaration does not have any legal force and authenticity and force nor it bind the origional owner in any manner. You can take few precautions and can clarify in writing your position legally to builder asking him not to rely on such declaration. You can also lodge complaint against notary.
