Court Legal Heirship Certificate

My mother mother & father expired. My younger sister is nominee everywhere in mother's FD & Insurance . I have Court Legal Heirship made after fathers death in which Mother, Me & My Younger Sister are legal heirs. Now after mother's death if I want recover part of my rights (money /fix asset ) from younger sister, old legal heirship certificate is ok to case the file & to recover it. Please help me by legal guidance.

She is bound to pay the other nominees if she receives the full amount. You can recover your share by filing a civil money recovery suit.

A.Hi,
Your sister has a responsibility to pay you your share of the amount. If she fails to do so, you can file a civil suit for money recovery.

A.Nominee has only to receive property/money but nominee is bound to distribute the received property/money among other legal heir. You can claim your share by filing suit for recovery.

A.Younger sister is nominee everywhere in mother's FD & Insurance, so she can only get those money.Court Legal Heir-ship made after fathers death in which Mother, You & Your Younger Sister are legal heirs are applicable only for the purpose for which it was applied for during the Legal Heir-ship Certificate. After your mother's death you can recover your part only on the money/fixed assets provided your mother has not made a WILL or NOMINEE in your younger sister's name.
