Hi,
We have applied for the bail from the court (KKD), but Investigating Officer and opposition family didn't show up today. The judge gave the new date, which is tomorrow. What if they still don't show up tomorrow, in that case, how can we get the bail?

A.Dear,

For hearing of your bail petition, the IO and the de-facto complainant need not be present at the court as the de-facto complainant will be represented by the public prosecutor in the case. Request your counsel to ask the court to hear the bail petition as expeditiously as possible.

A.sir,
The court will decide your petition tomorrow.The prosecution is duty bound to answer the court.

Opposition party already filed an FIR against us (354a IPC). Police by any time come at the door and arrest us.

A.The investigating officer should appear but if he does not appear, court is not bound to wait for him and decide the bail application. But the non appearance of the IO will go against the prosecution.
