I am interested to purchase a property which is registered in the name of couple husband died 5yrs back .Wife got made a legal heir certificate and she is working in the place of husband .now nagar nigam house tax is also in the name of wife and applied for a succession certificate from civil court but after more than a year still certificate is pending lawyer is telling us it takes 4 to 5 years to come she has notified and a newspaper news was also published.if we purchase this property Can we have some problem later

Legal Heir Certificate is sufficient to prove the interest over the property after the deceased. She can sell the property and you can purchase it even without the succession certificate. You wouldn't face any issues in the future. Thank You

A.Hi,
Since she has the legal heir certificate, she has an interest in the said property and therefore, she can sell it to you. You need not wait for the succession certificate to come. Legal heir certificate is enough to purchase the property of the wife. It wouldn't create any problem for you in the future. Thank You
