Mutual divorce settlement

Me and my husband have filed cases in family court against each other. I filed maintainance case me and son under section 125. Husband filed divorce case under section 13 ia. Now we have settled the matter with some terms signed in the divorce case. Now we want to ahead with mutual divorce. How should we proceed for mutual divorce and what to do for the cases we filed against each other? Do we have to withdraw all the cases and file a new petition for mutual divorce? Guidance needed.

A.Hi,
You can make a declaration that the cases would be withdrawn, the same will be added as a term in your mutual consent divorce settlement.

A.Not needed. You need to inform your lawyer who can ask from Court to provide Counselling session wherein terms can be finalized and you just require to withdraw all the petitions filed apart from Divorce petition and all other terms require to be fulfilled like alimony etc after which divorce petition can be converted to mutual divorce petition.
