Regarding fraud done by travel company

We have given our car on contract to one of travel agency. Now that person has done fraud by not giving us payment neither returning our car. One person is arrested n police giving 420, 406 in FIR. Can we claim about lost of our car from insurance company?

A.No you can not claim from insurance company.

A.In this scenario you cant claim Insurance amount from your company as it had not been stolen. It was given by you out of your own will to that travel company

A.Insurance company can challenge ur claim on the ground that that you gave your car if registered as a private vehicle for commercial use.if the vehicle is registered as a non private vehicle, then your claim will be allowed.

Thank you sir for reply.
It is T- Permit Car ( Yellow Number Plate) registered in Mumbai.
Also Car is take on loan, so once FIR is registered can I stop paying my car loan EMI on basis of FIR? as my earning is stopped.
