Hello,

I had ordered for an item with just 1 quantity and filled a form that I received from the seller which I have proof of.

I had then paid the full amount to the seller and then called them up informing I had paid for the item. After which they had shipped it.

A week or so later, I received an extra item in my name similar to the first one. I informed the delivery agent I did not order it he asked me to take it up with the seller. I called the seller up and nobody answered and I waited for a week but nobody contacted me. So I kept the extra item for a week and then and gave it to my friend.

Now after two months the seller is threatening me with legal action. Please let me know if they can do anything about it.

A.Kindly collect & retain all the proofs supporting that you tried your best to reach out the seller and he didn't revert. As u have NOT ordered so nothing much to worry. If a small amount pay to the seller in next 6 months at your ease, else you too hire a lawyer & defend the case for years.

A.Hi,
You can use all the proofs showing that you exhausted your chances of delivering the good back to the company. Or you can make the extra payment to the seller for the second item.

You are advised to collect all the proofs supporting that you tried your best to reach out the seller and he didn't revert. Further you can hire a lawyer to help yu.

A.You should have made more effort to return the extra item to the concerned platform back, however now either you make payment towards the same or you may return the item which is not something they will agree I guess so just try justify and answer in writing regarding that you had tried complaint about it but it wasn't responded etc and show them the soft copy of email/complaint or missed call details of the call which you might have made to seller. But you have not specified what is the item because if the item is not very costly there are notuch chances that the seller will take any legal action.
