Q. Maintenance for wife

My husband transferred all money and property to his brother account.now he said he don't have money for maintenance. He said he is not working at present,while I know he works from home but earning lots money.but I don't have proof .then what should I do ?

A. Dear Mam,
It is not relevant whether he is earning or not. Maintenance is an statutory obligation and that needs to be paid. Since, you are telling that he is not paying maintenance, then either you have allowed interim maintenance or your maintenance case has been disposed off by the court. You can file a prayer before the court stating that your husband is not obeying court orders. Court will take action.

If he denied to give maintanence , can I stay at matrimonial house?

A. Dear madam,
You can get details through court if case is pending . I can share relevant judgments wherein High Court asked the concerned to share such details.

Case is yet to start . But before that he is trying to hide evidence.he is earning 2 lakhs per month but work from home. on paper he has not any income. he said that he has big amount of home loans. Moreover I am Master of engineering.i was earning 50k permonth before marriage. Now I can't get job easily. Due to my education , I m eligible for maintanence ? Court may refuse my request .is it possible?

A. It doesn't matter whether he earns or not. If you file a case for maintenance he will have to pay such.

I m educated , before marriage ,before 4 years I was doing job. Is it possible that court may refused my request ?

A. Do let your husband to know that he will have to pay hefty amount instead if he will not pay the meager amount in which you are having the right to get.
