Hi,

My father had taken a home loan from SBI and returned it in full amount but bank has lost the original conveyance deed. I filed a complaint in RBI and they asked sbi to pay Rs 50000 which I think isnt enough. Talking to property people, they say that house value would be reduced by 30 percent from original price if there is no conveyance deed. My question is:

1) Is it a strong enough case to file it in a consumer court since RBI already ordered 50000 compensation. Should we accept this income or not?

2) If we hire a lawyer, how much time will it take in consumer court and how many hearings. Asking because my parents are senior citizens

3) how much amount should we ask for in consumer court

A.I have a doubt that Bank employees are soing some fraud by saying that they lose riginal documents. i have filed a case seeking 50 lakh compensation, case is still pending.

A.duplicate copy from registrar office which is as good as original.
it along with RBI letter, SBI letter is good enough.

but if you want then you can definitely approach consumer court.

A.As bank has lost the original conveyance deed, Rs.50,000/- is a bare minimum amount as compared to that of the original conveyance deed. But the duplicate can be obtained from the Registrar office which is somewhat equivalent to that of the original. But for the damage charges will depend on the cost of original conveyance deed and the market value price along with your income level (IF POSSIBLE TELL THEM TO AGAIN GIVE THE HOME LOAN ASSUMING THAT THEY ARE HAVING THE ORIGINALS). Consumer court will take around 3 years time.

You can challenge the amount in the Consumer Forum. It will take minimum 1-3 years as it depends on the facts of the case too. The amount should be based on your own will.

A.It is a myth that if original sale deed is list then value of property decreased. You can obtain certified copy from registrar office which is as good as origional. In consumer court it takes minimum three years. Amount of Claim depends upon your wish .
