ULTRA VIRES TO THE CONSTITUTION OF INDIA

By Notification dated 10.01.2013 I have been appointed Muhammadan Marriage Registrar for Bhagwangola PS for the purpose of REGISTRATION OF ALL Muhammadan Marriages and Divorces. My appointment was issued in tune with Section 3 of the Act by the Secretary to the Govt. of West Bengal, Judicial Department. Whether the proviso to Section 3 of the Bengal Muhammadan Marriages and Divorces Registration Act, 1876 is unconstitutional or ultra vires to the Constitution of India? It may be mentioned here that the intension of the legislature to pass the Act for only the reason to register Marriages and Divorces of Muhammadan Community. There is no definite mechanism to determine SUNNI OR SHIA SECT. Ple advice me grounds of challenge of the said proviso.
