Hi I have given cash to my friends friend as lending purpose as in the form of half amount cash and half amount in cheque with 100 rupees note signatures. by keeping his car with me for the total cash. And one day his car which was leaved at me as surety was me with one small accident and I given to showroom for claiming insurance to car and intimated him. Then without claiming insurance my friend payed for damage and taken car without intimating me.also he had not payed interest since 5 months.so what consequences will I face if he asks me car damage amount . Also I want to file FIR will I get my money?without claiming insurance he payed amount for damage is it legal

A.its his car, he can do whatever he wants.
you took possession of his car which was illegal until it was mortgage which it was not. '
you can not file FIR
you can file money recovery suit.

A.Dear Sir,
It is not a criminal case. You can file money recovery suit.
