Dear Sir,

My Uncle was died on 1995. He had 15 Acres of Agriculture Land. He bought this property from his father on 1964. And he has a wife and 2 Sons.

After My uncle’s death, His wife & son’s registered that property with 3 Partitions on 2003. First Part is allocated to his Wife, Second Part allocated to his 1st Son and Third Part is allocated to his 2nd Son. Everybody segregated each 5 Acres. At that time 1st son has not got married.

After that 1st Son has married on 2014 and he has a new baby born on 2015.

I bought 5 Acres Partitioned Property from his 1st Son on 2016. When register the Sales Deed, he mentioned that the property is going to sales due to his and his minor child future welfare. And Sales deed is signed by only 1st Son in their side. At that time of sales he has one child. After that he also has second child.

In 2019, 1st Son wife raise the regular civil suit in the court. In this case she mentioned her husband sold that property without her knowledge and also her husband not take care her and her children. So she reclaim that the property to her and her children maintenance.

Please suggest me if there is any possibilities to avoid reclaim my property as per law.

A.dont settle in pressure.
this play is used to extract money.
she have claim to her husband and not you until she was joint owner of property.
also dont leave possession of property in any circumstance.

A.Dear Sir,
If the sale was made in the lawful manner then she can't reclaim the property after the sale is done. Moreover if she wish to get maintenance for her child she should be taking the maintenance by her husband as it was sold for the welfare of the children. You need to show that it was done in lawful manner and you have its possession now.

A.Dear Sir,
If the wife was a joint owner of the property still the sale lawfully took place then she cannot claim the right that the deal was not done out of her knowledge. Moreover the sale was already done and if she want to claim the right for maintenance she should claim the money out of sale of property from her husband as in contract the sale was for the welfare of the children.

That suit is only formal. Your property cannot be taken away.
