One of my friend got married by Adarsh Samaj Samiti 1.5 years before and one certificate was issued to them. After that as the boy never told his family about the marriage so they both are living separately in different cities since marriage. Now also the boy is not willing to accept the girl socially as her wife or live together. The girl is now thinking of ending this marriage so that she can move on. Is it required for her to get divorce as they have never lived together and no one knows about their marriage. What is the best way to resolve this marriage?

A.Once married and certified also a marriage in a Temple or witnessed by any person is considered to be wedded legally in HMA, but to get separated is only by Law through divorce.

A.Repeated query. The fact is that both boy and girl are legally weded married couple. Living seperately or that boy had not told about marriage etc does not end this marriage. Divorce by mutual consent is best for getting divorce and to end this relation.

A.Hi,
Since you are married legally and the marriage has been solemnized it will be better if you are divorced, otherwise,
if there are relevant documents proving the validity of marriage then any future marriage will be void.

A.ANNULMENT is possible .
Divorce or annulment is NOT required if there is no witness but in your case there is Adarsh Samaj Samiti certificate which can create legal issues later in life.

A.Yes. The fact is that marriage was solemnised hence boy and girl are legally weded husband and wife in law. So to end this relation divorce is necessary for both the parties so to avoid all complications.

A.हिन्दू विवाह अधि के अन्तर्गत कोई भी शादी की जाती हैं।यदि कोई भी पक्ष दुसरी शादी करना चाहता है तो उसे पपहले सक्षम कोर्ट से तलाक लेना होता है।रही आपकी इस समस्या का यहाँ पर दोनो पक्ष सहमत हैं।तो दोनो को अदालत मे जाकर आपसी सहमति से तलाक लेना होगा।तभी दोनो पक्ष शादी कर सकते हैं।
उत्तर आपकी सम्सया के अनुसार हैं।
